TERMS OF SERVICE

These Terms govern your use of chronicaly.online and any purchase you
make from it. The site is operated by chronicaly.online, based in Chicago, Illinois ("we", "us").
By using this site or placing an order you agree to these Terms.
1. ELIGIBILITY
You must be at least 18 years old to place an order, or have the
permission of a parent or legal guardian who agrees to be bound by these
Terms on your behalf.
2. PRODUCTS
All items are made to order. Product photography and mockups are
representative. Slight variation in print placement, print colour, and
garment shade is normal in garment printing and is not a defect.
Measurements are listed on the sizing page and may vary by up to one
inch.
3. LIMITED AVAILABILITY
Designs are released for a limited period and are then retired. Retired
designs are moved to a public archive and are not reissued. We may retire
a design at any time, including before its stated expiry, and including
while stock or production capacity remains. Availability shown on the
site is not a guarantee that an order will be accepted.
4. ORDERS AND PRICING
Prices are in US dollars and may change without notice. We make every
effort to price and describe products accurately, but if an item is
listed at an incorrect price or with an incorrect description, we may
cancel the order and issue a full refund, whether or not the order has
been confirmed.
We reserve the right to refuse or cancel any order, including where we
suspect fraud, reseller activity, or a breach of these Terms.
5. PAYMENT
Payment is taken at the time of order. By submitting payment information
you confirm you are authorised to use the payment method provided.
6. INTELLECTUAL PROPERTY
All designs, graphics, text, logos, and site content are owned by us and
protected by copyright and trademark law. Buying a garment gives you the
garment. It does not transfer any rights in the design.
You may not reproduce, print, resell, or create derivative works from our
designs, including for personal or non-commercial use.
7. CUSTOMER PHOTOS AND SUBMISSIONS
If you tag us, mention us, or send us photographs of our products, you
grant us a non-exclusive, royalty-free, worldwide licence to reproduce
and display that content on our website, marketing materials, and social
channels, with attribution to your handle where practical. You confirm
you own the content and have the consent of anyone identifiable in it.
You can ask us to stop using your content at any time by emailing
support@chronicaly.online.
8. THE PATIENT TAG
Our garments ship with an inner label containing a blank field intended
to be filled in by hand. Anything you write on the garment is yours
alone, is not endorsed by us, and voids eligibility for return or
replacement.
9. LINKS AND THIRD PARTIES
Fulfilment, payment processing, and shipping are handled by third-party
providers. Their handling of your information is governed by their own
policies.
10. DISCLAIMER
The site and its content are provided "as is" and "as available" without
warranties of any kind, express or implied, to the fullest extent
permitted by law. We do not warrant that the site will be uninterrupted
or error-free.
11. LIMITATION OF LIABILITY
To the fullest extent permitted by law, our total liability arising out
of or relating to any order is limited to the amount you paid for that
order. We are not liable for indirect, incidental, special, or
consequential damages.
Some jurisdictions do not allow certain limitations of liability, so
parts of this section may not apply to you.
12. INDEMNITY
You agree to indemnify us against claims arising from your breach of
these Terms or your misuse of the site.
13. GOVERNING LAW
These Terms are governed by the laws of the State of Illinois, without
regard to conflict of law principles. Any dispute will be brought in the
state or federal courts located in Cook County, Illinois.
14. CHANGES
We may update these Terms at any time. The version posted at the time you
place an order is the version that applies to that order.
